Actos Lawsuits Move Forward, as Nevada Judge Denies Mistrial Bid in Actos Bladder Cancer Trial, Bernstein Liebhard LLP Reports

The Firm is evaluating Actos lawsuits on behalf of individuals who allegedly developed bladder cancer due to long-term use of Actos.

New York, New York (PRWEB) April 12, 2014

Actos lawsuits (http://www.theactoslawsuitcenter.com/) alleging that long-term use of the Type 2 diabetes drug caused patients to develop bladder cancer continue to move forward in federal and state courts throughout the country, Bernstein Liebhard LLP reports. According to court documents, the Nevada Circuit Court Judge overseeing an Actos trial currently underway in Clark County has rejected Takeda Pharmaceuticals bid for a mistrial, after the company asserted that an article published by a local media outlet precluded a fair trial. (Case Nos. A-13-680556, A-13-680922)

The trial in question involves Actos lawsuits filed by two Las Vegas women who allegedly developed bladder cancer after using the medication for more than one year. According to their complaints, they have both been forced to undergo multiple surgeries to treat their cancer. The women are seeking a multi-billion verdict, which would be the largest ever awarded in Nevada.

The allegations put forth in the course of this trial echo much of what we have heard from our own Actos lawsuits clients. We are watching developments in the case very closely, says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm is currently offering free legal evaluations to individuals who were treated with Actos for a year or more, and who allegedly went on to develop bladder cancer due to their use of the drug.

Actos Bladder Cancer Allegations

According to court documents, the cases currently at trial in Nevada are among more than 3,000 Actos bladder cancer claims currently making their way through U.S. courts. The majority of these cases have been filed in a federal multidistrict litigation now underway in U.S. District Court, Western District of Louisiana. All of the claims accuse Takeda Pharmaceuticals and other defendants of concealing the association between Actos and bladder cancer from the public and medical community. (In re: Actos Product Liability Litigation, MDL No. 2299)

On April 7, 2014, the jury hearing arguments in the first trial of an Actos lawsuit in the federal proceeding returned a multi-billion verdict favoring the plaintiff. According to court documents, the judgment consisted of $ 1.475 million in compensatory damages, and $ 9 billion in punitive damages. The punitive damages were split between Takeda, which was ordered to pay $ 6 billion, and Eli Lilly & Co., which was ordered to pay the remainder. According to a report from Bloomberg.com, the punitive damage award ranked as the seventh largest in U.S. history, and was assessed after a jury found the two companies acted with wanton and reckless disregard for patients safety.* (Allen v. Takeda Pharmaceuticals North America Inc., 12-cv-00064)

Court records indicate that the Actos bladder cancer litigation began to grow following the publication of a U.S. Food & Drug Administration (FDA) alert in June 2011, which warned that use of Actos for more than 12 months had been linked to a doubling of the risk of developing bladder cancer.

Actos users who allegedly developed bladder cancer due to extended use of the drug may be entitled to file their own Actos lawsuit. To learn more about the Actos bladder cancer litigation, please visit Bernstein Liebhard LLPs website. For additional information, please call 800-511-5092 today.
